Best Ways For Avoiding Foreclosure

The majority of homeowners have a mortgage on their home and make regular monthly payments in order to stay current and to protect the ownership of their homes. The terms of the mortgage contract are well laid out and agreed upon by both the homeowner and the lender. That’s why a borrower can feel very foolish as well as embarrassed when crap happens and they miss a few of the mortgage payments.

Such problems can seem very personal and it usually has something to do with a loss of the job or a health crisis. The combination of personal problems with the business arrangement can be very difficult as well stressful for the homeowner. The real challenge begins when the homeowner allows embarrassment to get in the way of dealing with the lender.

How to Do It

If the homeowner can understand that by defaulting on a mortgage it becomes a real problem for the lender, it might be easier to ask for help in avoiding foreclosure. If the borrower understands that mortgage problems are not unusual and that he/she is not the first, then the feeling that he/she is asking for special treatment can be overcome enough to seek help in avoiding foreclosure. By talking with the lender, the homeowner will see that repayment plans for late payments are easy to understand and follow; thus he may actually managed to be successful in avoiding foreclosure.

Statistically speaking, mortgage lenders on average lose almost $60,000 on every foreclosure. Almost half on the mortgage borrowers fall dangerously behind on payments. The good news is that these lenders are both motivated and experience in arranging repayment plans to assist in avoiding foreclosure. As soon as a homeowner recognizes that there is going to be a problem in making the monthly payments, he should contact the lender ASAP and explained his situation to them.

If necessary, a third-party can also negotiate on behalf of the borrower too.

There are basically five types of plans that are used by people for avoiding foreclosures. A person might find himself or herself in this situation where they have a short-term drop in income or an unexpected increase in expenses, which leads to the missing of several payments but results in a return to the previous ability to pay. In this case, a partial reinstatement plan can be set up. This plan allows the payer to resume regular payments when it is possible while making up for the missed payments in smaller payment chunks over the course of a specific the amount of time. Another option is a short-term forbearance, which can suspend as many as three payments or reduce the payments for as many as six months.

Just like the partial reinstatement plan, a repayment plan allows the missed or reduced payments to be made up while resuming the full payments. If necessary, forbearance can be put on a long-term basis, stretching the payments between 4 to 12 months. Forbearance can help take the pressure off and result in avoiding foreclosure. If that income loss its permanent, modifications can be made to the mortgage agreement. The loan period can be extended for lower payments or interest can be renegotiated. Occasionally the FHA will pay the money for missed or late payments to bring the loan up-to-date and then arrange for repayments after the home is sold or when the mortgage is paid off. Successfully avoiding foreclosure is a win win situation for all parties involved.

Because you have the mortgage foreclosure appraisal with you, assessing the value of your property is a lot easier and you can make a more informed decision on what to do next. You may also have the option of avoiding foreclosure, like selling it before the lender will foreclose your property. Refinancing is another option for you if you want to avoid foreclosure on your home. But beware of second mortgage that is high risk as it may cause your harm than good. Bear in mind that if you have an option of refinancing or taking a second mortgage, your lender will let you know that because they have vested interest in your mortgage.

Armed with the mortgage foreclosure appraisal in your hand, and knowing the dos and donts of foreclosure, you will undoubtedly make best decision on how to deal with your mortgage.

The holidays are a horrible time to be facing foreclosure. The entire spirit of the holiday is dampened by the foreclosure that is hanging over your head. But rather than focusing on the foreclosure, focus on ways that you can stop mortgage foreclosure during this holiday season.

Here are a few tips to help you focus on what you can do to stop mortgage foreclosure during this holiday season:

1. Focus on what you can control instead of what you cannot. You cannot control who your mortgage company is or what solutions they may or may not be able to offer you. Let go of blaming them. That will get you nowhere with them. You can control how you react to your mortgage company. You can be pleasant to the people that you talk to at your mortgage company. You can choose to work with the people at your mortgage company. You have a far better chance of being able to stop mortgage foreclosure if you are actively trying to work with your mortgage company.

2. Stay away from giving monetary gifts. If you are facing foreclosure, you are certainly going through a difficult time financially. The holidays are a time when we typically express our love through gifts. Instead of giving things during this holiday season, give other kinds of gifts. Gifts of service or gifts of your talents are often more appreciated than gifts that cost money. Your friends and family will understand that you are trying to stop mortgage foreclosure on your house.

3. Focus on what is truly important to you in your life. At the end of the day, a house is a house. A home is wherever you make it. Your family and friends are far more valuable than the house that you live in. Be sure to take time during this holiday season to be with people who love you, care about you, and support you in all that you do. Remember that these are people who will love and support you as you work on being able to stop mortgage foreclosure on your house and they will love and support you even if you are unable to do so. Is there any way to stop an eviction after a judgement has been entered & Writ of Possession beside bankruptcy

judgement was made against me in court in a retalitory eviction for with holding rent in desperation of needing significant repair work done in my rental apartment for well over a year BECAUSE I was mistaken as to the time and was 10 minutes too late; IS THERE ANY WAY TO HAVE MY SIDE HEARD BEFORE THE COURT AND LEGALLY DELAY THE WRIT OF POSSESSION UNTIL THIS CAN OCCUR?

Unfortunately not. At this point in the process the only thing you can really do is find another place to live. Although, with the eviction recorded against you in the public court records you may have a hard time finding another landlord to rent to you.

This also wouldn’t fall under the definition of retaliatory eviction. For this to be a retaliatory eviction the landlord would have to evict you for wanting the items repaired. Once you began to withhold rent it became a clear cut eviction case for breaking the lease.

The only advice I can give here is to try and find another place to live quickly. At this point if you don’t have your items out by the time the sheriff comes they will be placed on the street.

Also, you will most likely want to satisfy the judgment against you as quickly as possible. It will follow you from here on in and other landlords will see it both in the public court records and on your credit report which will have a definite impact on your future rental and also mortgage applications should you ever decide to purchase a home.

I recently turned down an applicant for one of my rental properties because she had not disclosed to me an eviction on her record from 6 years ago. As soon as I ran her credit it came right up. I went to the court records and saw that it was still outstanding. I figured if she didn’t pay that landlord there is a good chance she might not pay me and I moved on to the next applicant.
